1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of Heim ("Heim," "we," "us," or "our"), including our website, dashboard, and related services (collectively, the "Service"). By creating an account, connecting a channel, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
Heim helps creators analyze public comments from connected YouTube and Instagram accounts. We fetch comment data through platform APIs, process it (including with automated and AI-assisted tools), and present summaries such as sentiment and themes. Features may change, be added, or be removed at any time.
3. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You represent that you have the right to connect any channel or account you link to Heim and that doing so complies with the applicable platform's terms and policies.
4. Accounts and access
- You sign in with an email address and a secure link we send you. Keep access to your email account secure; activity through your Heim session is treated as yours.
- We may require manual approval before full dashboard access. We may suspend or revoke access if we reasonably believe you violated these Terms or pose a risk to the Service or other users.
- You are responsible for all activity under your account and for notifying us promptly at hello@useheim.com if you suspect unauthorized use.
5. Third-party platforms
The Service integrates with third-party platforms (such as YouTube and Instagram). Your use of those platforms remains governed by their own terms and policies. We are not responsible for third-party services, outages, API changes, or content removal on those platforms. You may disconnect integrations at any time through your account settings; previously synced data may remain stored as described in our Privacy Policy.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Access or attempt to access another user's account or data without authorization.
- Reverse engineer, scrape, or overload the Service except as permitted by applicable law or platform terms.
- Upload malware, interfere with security, or disrupt the integrity or performance of the Service.
- Misrepresent your identity or your authority to act on behalf of a channel or brand.
7. Your content and our license
You retain ownership of content you control on connected platforms. To operate the Service, you grant us a limited, non-exclusive license to access, store, process, and display comment and related metadata you authorize us to sync, solely to provide and improve the Service. This license ends when you delete relevant data or close your account, subject to reasonable backup and legal retention periods.
8. AI-generated insights
Summaries, sentiment labels, themes, and similar outputs may be generated automatically and can be incomplete or inaccurate. They are provided for informational purposes only and do not constitute professional, legal, or business advice. You are solely responsible for decisions you make based on Service output.
9. Fees
We may offer free and paid plans. If we introduce paid features, we will describe pricing and billing terms before you are charged. Unless otherwise stated, fees are non-refundable except where required by law.
10. Intellectual property
Heim and its branding, software, and documentation are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as needed to use the Service in the ordinary course.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT INSIGHTS WILL BE ACCURATE OR COMPLETE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEIM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
13. Indemnification
You will defend, indemnify, and hold harmless Heim from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your connected content, or your violation of these Terms or third-party rights.
14. Termination
You may stop using the Service at any time. To delete your account and associated data, follow the instructions in section 11 of our Privacy Policy. We may suspend or terminate your access with or without notice if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive termination.
15. Changes
We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes may also be communicated by email or in-product notice where appropriate. Continued use after changes take effect constitutes acceptance of the revised Terms.
16. General
These Terms are the entire agreement between you and Heim regarding the Service. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
